Official Contest Rules for the Appleton’s Adventures Photo Competition/ Sponsor: Apple Core Hotels

Competition Terms and Conditions

I.     Eligibility and Sponsor Rights:

The “Appleton's Adventures” Photo Competition (the "Contest") is void where prohibited by law, or where the registration or filing requirements of any state or local jurisdiction have not been complied with.  Contest is limited to residents of the United States.  This Contest is not open to employees of Apple Core Hotels, and their respective parent companies and subsidiaries, including their immediate families, affiliates, distributors, retailers, advertising and promotion agencies.  This Contest is open to all registered Site users younger than 18 years old on December 1, 2009. You must obtain written permission from your parent or legal guardian ("Parent") to participate in the Contest and have your picture posted on the Site.

NO PURCHASE NECESSARY TO ENTER OR WIN. Entrants are neither encouraged nor required to purchase any product or service in order to enter the Contest. There will be a limited supply of Appletons and they will be distributed starting December 20th, 2009 on a first-come-first-served basis at Apple Core Hotels' front desks until supplies last.

By entering the Contest and sending a picture to MyAppleton@gmail.com each Entrant confirms that he/she has read and agreed with these Official Contest Rules. Failure to do so and abide by said rules could lead to disqualification from the Contest.

1)    Entrant understands that the odds of winning depend on the number of entries received.   All photos submitted must be originally created material because any unauthorized use of copyrighted property other than the Entrant’s may not be used. The photo cannot contain any commercial endorsements. Nudity, profanity or violence is not allowed. The foregoing requirements/restrictions will be strictly enforced and any submissions that do not, in Sponsor's sole discretion, comply with all of the foregoing requirements will be disqualified.

2)    Each Entrant agrees and grants Sponsor permission to make available and display/perform and otherwise distribute, Entrant's name and photo submission sent to the website designated to the Appleton’s Adventures Competition (http://AdventuresWithAppleton.com) (The Site”) in connection with all media as per the terms of the Appleton's Adventures” Agreement.  Except where legally prohibited, submission of an entry into this Contest constitutes permission for Sponsor or any of the Sponsor’s owners, directors, partners, affiliates, successors or assigns (“Apple Core”) to use the Entrant's name, testimonials. photograph, likeness, voice, address (city and state) any information or literal quotations from the Entrant’s answers to the questions completed in his/her e-mails, in print, broadcast media or new media, in perpetuity, or in any manner Sponsor deems  appropriate, in connection with promoting the photo submission itself or this Contest, without further compensation to the Entrant..

3)    RELEASE: In regard to the above, Entrant further agrees that by initially sending his/her picture to MyAppleton@gmail.com, he/she is irrevocably authorizing and consenting to its use and reproduction by the Sponsor and Apple Core, of any and all photographs, images, video clips or other material Entrant posts on the Site  for whatever purpose whatsoever, but not limited to the Entrant’s full name and city of residence without legal recourse against the Sponsor or Applecore or for additional compensation.  All material as indicated shall constitute the property of Apple Core and may be copyrighted by Applecore. Nothing herein shall constitute an obligation on the part of Apple Core to make use of any of the rights set forth herein.

4)   Contest Submissions Deadline

Entries must be submitted and received by Apple Core Hotels by email at MyAppleton@gmail.com between December 20, 2009 at 12:01 a.m. Eastern Standard Time, and February 28, 2010 at 11:59 p.m. Eastern Standard Time, to be eligible to win.  Sponsor is not responsible for telephone, network, electronic or computer failures of any kind, or for entries that are stolen, misdirected, incomplete, garbled, or delayed by computer transmissions. In the event this contest is compromised in any way, electronically or otherwise, that is beyond the control of the Sponsors, they reserve the right (a) to suspend, modify, or cancel the Contest in their sole discretion if a computer virus, bug or other technical problem corrupts the administration or security of the Contest, and (b) to select winners from among all eligible entries received prior to the cancellation date.

5) Prize

Prizes: The following prizes will be awarded:

Prizes: Five (5) iPods Shuffle. Approximate retail value:  $59.00.  The iPod Shuffles will be mailed in a box that will contain the iPod shuffle, earphones, a USB dock and a quick start guide. No additional accessory will be provided in the box.

Official Prize Schedule: Entry Deadline is February 28, 2010.

Total Approximate Retail Value of All Prizes: $295.00 ($177 = $59 * 5 iPods Shuffle). 

Maximum of one (1) iPod Shuffle sent per family.

6) Winner Selection

Prize winners will be selected from among all eligible entries received by a panel of judges selected by the Sponsor after evaluating the entries. No substitution of prizes is permitted. The Sponsor is not responsible for lost or mutilated prizes problems associated with redemption and none will be replaced. Prizes are nontransferable, non redeemable for cash and must be accepted as awarded. All federal state and local taxes on prizes, including income taxes, and any incidental expenses associated with the collection of  prizes are the responsibility of the winner. Winners assume all liability for any damages caused or claimed to be caused by participation and further agree that the Sponsor have no liability for technical or computer malfunctions, or for injuries or losses of any kind resulting from Contest Entry. Acceptance of prize constitutes permission (except where prohibited by law) to use winners' name for purposes of advertising, promotion and publicity without additional compensation.

7) Winner Notification

The winners will be notified by e-mail within ten (10) business days of winning. If a winner does not respond within ten (10) business days after the date of notice from the Sponsor, an alternate winner may be selected. The Sponsors shall not be liable for (1) failed, returned or misdirected notifications based on inaccurate information provided by the winner (2) entries and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind. The Prize winners and each Runner Up will be given ten (10) business days from the first day of notification to respond to claim prize(s). A non-response by the winner or non-receipt of notification response after the specified ten (10) business days will be considered a forfeiture of the prize and an alternate winner may be selected from the pool of eligible entries. If an Entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries.

8) Releases
By participating, Entrants agree that the Sponsors and those involved in the development, production (including prize suppliers), implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes. All Entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify Sponsors from any and all such claims, including the attorneys' fees related thereto. The Sponsors shall not be responsible for any technical malfunctions of the telephone network, computer on-line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant's or any other person's computer related to or resulting from downloading as part of this Contest. Any person attempting to defraud or in any way tamper with this Contest will be ineligible for prizes and may be prosecuted to the full extent of the law.

9) New York Law Governs

This Contest shall be governed by New York law. By participating in this Contest, Entrants agree that New York courts shall have jurisdiction over any dispute or litigation arising from or relating to this Contest and that venue shall be only in New York, New York.
